Pitfalls of the CICA Scheme

Claiming compensation via the Criminal Injuries Compensation Scheme is not easy and a process for which claimants are best served by having appropriate legal assistance.

The key pitfalls that claimants try to navigate include the following;

  1. Claiming out of time – you have two years to make a claim unless it relates to a period of abuse. It may be that psychological trauma has accounted for the delay and the onus is on the claimant to prove this.
  2. Having a criminal record can prejudice the claim.
  3. Declaring inaccurate information as part of the process.
  4. Not responding to requests for information.
